non-exclusive Agency for placing indie music in film and commercials

has anyone considered joining PUMP AUDIO. ?

They are a music database specializing in placing music and film, TV and commercials. Like a good ambulance-chasing lawyer, they assure you that until you make money, you don't pay them a dime. If they do place you it's 50/50. Which could be a lot.

Their non-exclusive concept is as attractive as that concept always is--putting the service in the "why not" category in my books. In other words we need to look for a good reason why NOT to go ahead and upload.

The FAQ's make things quite clear and look, generally, fair and favourable.

Here are the few answers that might cause some concern, though. Look forward to any feedback on this.

Do I get to approve where and when my song can be used?

No. Your agreement with Pump allows us to license your music to any client who is willing to pay money for its use. The agreement you sign with Pump pre-clears all of your music for potential licensing. Pre-clearance is a strong selling point for our clients who are more likely to use music that causes them less hassle.

This means you have no say if Starbucks, Phillip Morris, or the Home Depot want to use your music in a major campagin. Are you ready for that? Is teh dough, and instant flash-in-the-pan fame worth risiking alienating hard-earned fans? It could turn out ugly...

Secondly....

If I license my music to Pump Audio, can I still do other things with it?

Definitely. You are providing your music to Pump Audio on a non-exclusive basis, and are not restricted in any way with respect to what else you may want to do with your music. In certain cases, a customer may want to have the exclusive right to use the music for a particular application, in which case Pump would deal directly with you to get your approval and negotiate such an exclusive arrangement.

Does this mean PUMP will demand to be cut in on deal that wants exclusive rights to media you've uploaded to pump?
Even if you manage to find that potential lisencee on your own or with another service? Seems like that.

Then again, wouldn't we all kill to have the above delemma's to stuggle with?
Of course, The far more likely "worst case scenario" applies to any non-exclusive agency (which is usually happy to add unlimited talent to the roster just in case someone calls up asking for a band that happens to rhyme with your name)-- that is that nothing happens at all. But in that far-more likely "worst case" the time spent uploading and setting up yet another profile is the only cost.
